Merz's Migration Plan Sparks Debate

Published: 2025-01-28

CDU leader Friedrich Merz has proposed stricter border controls, including turning away migrants without valid entry documents.

He argues that Article 72 of the Lisbon Treaty allows Germany to prioritize national security over EU migration laws.

However, critics, including SPD and Green Party members, claim this violates both EU law and Germany's constitution, which protects asylum rights.

The European Court of Justice has historically rejected similar interpretations of Article 72. Meanwhile, the Police Union has called Merz's plan impractical, citing resource limitations and the need for significant investments in personnel and technology.

Additionally, Merz's willingness to collaborate with the far-right AfD on migration policy has drawn sharp criticism from SPD leaders, who warn against eroding democratic norms.
