The Federal Court of Justice (BGH) in Karlsruhe has confirmed the conviction of a Weimar judge for judicial misconduct related to the COVID-19 mask mandate at two schools.
The judge, Christian D.
, had issued an injunction in April 2021 to lift the mask requirement, despite not having jurisdiction over such matters.
His decision was later overturned by higher courts.
The Erfurt Regional Court found that he had deliberately sought to influence the outcome by selecting favorable experts and had misused his judicial position.
Both the judge and the prosecution appealed the two-year suspended sentence, but the BGH dismissed these appeals, making the conviction final.
This ruling underscores the importance of judicial impartiality and adherence to legal boundaries.
