Germany's Federal Constitutional Court has ruled that the extradition of a non-binary individual, known as "Maja," to Hungary was unlawful.
The person, accused of participating in attacks on right-wing extremists in Budapest in 2023, was handed over to Hungarian authorities in June 2024 despite a court order temporarily halting the extradition.
The court criticized the Berlin Kammergericht for failing to adequately assess Hungary's prison conditions, which reportedly include isolation and overcrowding.
The decision highlights concerns over human rights violations and sets a precedent for similar cases.
Maja's lawyer called the ruling a legal victory but noted it does not immediately improve their client's harsh detention conditions in Hungary.
